Introduction
This notice applies across all websites and apps that we own and operate and all services we provide, including our online wellness programs, and any other apps or services we may offer. For the purpose of this notice, we’ll just call them our ‘Online Gym service’.
When we say ‘personal data’ we mean identifiable information about you, like your name, email, address, telephone number, bank account details, payment information, support queries, community comments and so on. If you can’t be identified (for example, when personal data has been aggregated and anonymised) then this notice doesn’t apply.
We may need to update this notice from time to time. Where a change is significant, we’ll make sure we let you know – usually by sending you an email.

Who are ‘We’?
When we refer to ‘we’ (or ‘our’ or ‘us’), that means Bornz Limited and all its websites, apps, and services. We are a husband and wife team located in New Zealand but with customers all over the world. Our company address is 17e Nga Parae Road, Tauranga, New Zealand.
We provide health & fitness education and resources to help users lead healthier, more active lives. The means by which we provide this education and resources is via our following websites (“Websites”):

This privacy policy also applies to any fitness and electronic body monitoring products (“Devices”) that are connected via API to any of our websites, such as a Fitbit. The Devices, Websites and Apps are collectively referred to in this privacy policy as the “Online Gym Service”, or when we refer to ‘we’ (or ‘our’ or ‘us’).

For European Union data protection purposes, we act as a controller in relation to your personal data.
 
What Data Do We Collect?
Below are the ways that we collect your data. Some data you provide us directly. Some data we collect automatically. We collect this data to provide you the service you want and best experience possible. If you don’t want to provide us with personal data, you don’t have to, but it might mean you can’t use some parts of our websites or services.
When You join any of our Sites as a member
When joining any of our Sites as a member, you may be asked to enter personal information about yourself, such as height, weight and gender. We use this information to personalise the information and service to you, such as programs, workout plans and meal guides.
When you connect a Device
If you have a Device and connect it to our website service, we pull data from the 3rd party service and display it on our website. Depending upon the specific Device you connect, it can collect the number of steps you take, your weight, measure your sleep quality and transmit this data to Online Gym. By connecting your device to our website, you are giving us permission to collect and display this data provided by the Devices API on our website.
You can disconnect your Device from our website service at any time, at which point we will not be able to collect or display any further data from your Device.
When You Sync Your Device
When you sync your device, data about your activity is transferred from your device to our servers. This data is stored and used to provide the Online Gym Service. Each time a sync occurs, we also log data about the transmission. Some examples of the log data are the sync time and date, device battery level, and the IP address used when syncing.
Alternative Account Facebook Login
You will have the option to connect your Facebook account to your Online Gym account, which gives you the option to login to our Sites with your Facebook credentials. If you choose to do so, we will ask permission to access basic information from that account, like your name, profile picture, and friend list. You can stop sharing that information with us at any time by disconnecting the link to your Facebook account on our Site.
When You Add Information to Your Account
You can customize your Online Gym experience by adding other types of information to your account, such as by adding a food log or by setting an alarm, personalizing your profile with photos, participating in discussion boards, or sending messages to your Online Gym friends. Whenever you add this type of data, we collect it and store it with your other account information.
When You Visit a Site
We collect some data from everyone who visits our websites — even if you don’t have an Online Gym account.
Whenever you visit a website, we collect industry standard log data that records information about your visit, such as your browser type, operating system, the URL of the page that referred you, the different actions you performed, and the IP address from the pages you visited. We use this type of information to provide you with information that’s relevant to your location and to make sure the Site is working properly. We also collect data from cookies. When You Make Payments For Our Website Membership
When joining the Online Gym service, we store your Credit Card or payment details in order to make monthly subscription payments that occur automatically. We use a third-party payment processor (eWay) to process these payments. We also store your shipping details that you provide during the payment process. We keep this to help verify your Credit Card details.
When You Contact Us For Help
Whenever you contact Online Gym for help, we collect your name and email address along with any additional information you provide in your request and store it on our servers in order to provide you with customer service and to improve the Online Gym Service. You can also contact Online Gym through public forums such as Twitter or Facebook; however, we cannot maintain the privacy of your communication to us if you contact us through these channels.
When You Complete A Questionnaire
The Online Gym website provides Questionnaires to help the user determine where they are lacking in their health and fitness, and where they can improve. This information is stored on our servers and associated with your membership account. By completing any questionnaire and submitting the answers, you are agreeing for this information to be analysed by our Online Gym qualified Personal Trainers to provide help and guidance from the results. The results of your questionnaire will never be made public in a way that you can be personally identified and tied to the results.
When You Buy a Product
When you purchase a product from us, we will collect your name, address and contact details, as well as shipping address details for where you would like us to deliver your product. We use a third-party payment processor (eWay) to process your payment, and store your Credit Card details for any future payment you wish to make. You can contact us at any time to ask us to remove your Credit Card details from being stored.
When You Request An Educational PDF Resource
For us to send you the PDF resource you requested, we ask for your name and email address to send it to.
 
How We Use Your Data
First and foremost, we use your personal data to operate our websites and provide you with any services you’ve requested or are paying for, and to manage our relationship with you. We also use your personal data for other purposes, which may include the following:
To communicate with you. This may include:

  • providing you with information you’ve requested from us (like a pre-sales question) or information we are required to send to you (like a major update to this Privacy Notice)

To enable you by analysing, aggregating and reporting: We may use the personal data we collect about you to report it to you so you can make better informed decisions about your wellness. For example, if you are an Online Gym member, knowing what video workouts you have already viewed and having them automatically displayed in your Online Gym diary allows you to keep track of your progress. Aggregating your data allows you to see trends and ways you might be able to improve your health.
To maintain integrity: We use your data to troubleshoot the Online Gym Service, enforce the Online Gym Terms of Use, and/or detect and protect against error, fraud or other criminal activity.
 
How We Share Your Data
There will be times when we need to share your personal data with third parties. We will only disclose your personal data to:

  • third party service providers and partners who assist and enable us to use the personal data to, for example, support delivery of or provide functionality on the website or services, to market or promote our goods and services to you, or to ship your product purchases to you
  • regulators, law enforcement bodies, government agencies, courts or other third parties where we think it’s necessary to comply with applicable laws or regulations, or to exercise, establish or defend our legal rights. Where possible and appropriate, we will notify you of this type of disclosure

Data that You Direct Us to Share
You can direct us to share data with other parties. For example, you might authorize us to link your Online Gym account with a third-party service such as Facebook, or send status updates to your Facebook account. Once you direct us to share your data with a third party, that data is governed by the third-party’s privacy policy. You can revoke your consent to share with the third party at any time in your Online Gym account settings or by sending us an email to [email protected] .
 
International Data Transfers
When we share data, it may be transferred to, and processed in, countries other than the country you live in – such as to the United States, where our data hosting provider’s servers are located. These countries may have laws different to what you’re used to. Rest assured, where we disclose personal data to a third party in another country, we put safeguards in place to ensure your personal data remains protected.
For individuals in the European Economic Area (EEA), this means that your data may be transferred outside of the EEA. Where your personal data is transferred outside the EEA, it will only be transferred to countries that have been identified as providing adequate protection for EEA data (like New Zealand).

Security is a priority for us when it comes to your personal data. We’re committed to protecting your personal data and have appropriate technical and organisational measures in place to make sure that happens.

We’ll retain your personal data for as long as we have a relationship with you and for a period of time afterwards where we have an ongoing business need to retain it, in accordance with our data retention policies and practices. Following that period, we’ll make sure it’s deleted or anonymised.
